1. Agreement
By accessing or using Headland, you agree to these Terms of Service. If you do not agree, do not use Headland. Headland is operated by Headland Technologies Ltd., an Alberta, Canada company.
These Terms apply to the Headland web application, mobile application, public website, and related services.
2. What Headland Does
Headland helps farms keep and use records across fields, bins, inventory, equipment, service, weather, grain movement, contracts, tools, team work, photos, reports, and assistant conversations.
Headland may organize records, calculate values, scan documents, summarize information, surface patterns, and answer questions from your farm context. The goal is to make farm records easier to capture, search, understand, and act on.
3. Decision Support, Not a Replacement for Judgment
Headland is a record-management and decision-support tool. It is not a substitute for your own judgment, professional agronomic advice, legal advice, financial advice, veterinary advice, safety advice, or regulatory compliance obligations.
Assistant responses, weather windows, market context, calculations, product information, equipment information, scanned-document extraction, and other outputs may be incomplete, inaccurate, outdated, or inappropriate for your farm's exact conditions.
You are responsible for verifying important information before acting on it.
4. Crop Protection, Weather, and Field Decisions
Always verify crop protection products, rates, restrictions, re-entry intervals, pre-harvest intervals, tank mixes, registrations, labels, and local requirements against the official product label and applicable law. In Canada, the label is the legal document governing product use.
Weather, spray-window, inversion, frost, disease-risk, and crop-threat features are provided for planning and context. They do not guarantee safe or successful field conditions.
5. Your Data
Your farm data belongs to your operation. Headland does not claim ownership of the farm records, photos, notes, contracts, tickets, service records, field history, team records, or other content you enter.
You grant Headland permission to process your data only as needed to operate, secure, support, improve, and provide the service. Our handling of data is described in the Privacy Policy.
You are responsible for the accuracy, legality, and appropriateness of the data you enter, upload, invite others to enter, or ask Headland to process.
6. Farm Accounts, Owners, and Employees
A farm may include owners, admins, employees, family members, consultants, or other invited users. Farm owners and admins are responsible for deciding who belongs in the farm account, what access they should have, and when access should be removed.
If you invite employees or contractors, you are responsible for making sure your use of Headland complies with applicable employment, payroll, privacy, safety, and workplace requirements.
Farm owners and admins are responsible for reviewing exports, reports, time entries, payroll notes, and employee-submitted records before using them for payment, discipline, compliance, insurance, tax, or other formal purposes.
7. Free Access and Future Paid Features
Headland currently offers free access. We may introduce paid features, subscriptions, or usage limits in the future. If we do, pricing and billing terms will be clearly presented before you are charged.
We will not charge you for paid features unless you choose to purchase them through a clearly presented checkout, app-store flow, or other explicit payment process.
8. Acceptable Use
You agree not to:
- Use Headland for unlawful, harmful, abusive, or fraudulent purposes.
- Attempt to access another farm's data without permission.
- Share login credentials instead of inviting users properly.
- Interfere with Headland's security, infrastructure, or availability.
- Upload malware, unlawful content, or content you do not have the right to use.
- Reverse engineer, scrape, or automate Headland in a way that harms the service.
9. Availability, Offline Use, and Changes
We work to keep Headland available, but we do not guarantee uninterrupted or error-free service. Features may be unavailable because of maintenance, connectivity, provider outages, weather data availability, app-store changes, device limitations, or other causes.
Headland may change over time. We may add, remove, modify, or limit features as the product develops.
10. Deletion, Export, and Termination
Headland includes export and deletion controls for farm records. Farm owners can delete farm data in Settings. Account deletion can be completed immediately from Settings through the data deletion page.
Deletion may be limited where retention is required for security, legal compliance, payment records, tax records, backups, dispute handling, or to protect the rights and safety of Headland or others.
You may stop using Headland at any time. We may suspend or terminate access if we reasonably believe these Terms have been violated, the service is being abused, or continued access creates a risk to Headland or other users.
11. Disclaimers
Headland is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of accuracy, completeness, fitness for a particular purpose, merchantability, non-infringement, uninterrupted availability, and error-free operation.
12. Limitation of Liability
To the maximum extent permitted by law, Headland Technologies Ltd. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including crop loss, yield loss, quality loss, market loss, lost profits, lost data, equipment damage, environmental harm, regulatory penalties, business interruption, or decisions made using Headland.
To the maximum extent permitted by law, our total liability for any claim related to Headland will not exceed the greater of $100 CAD or the amount you paid Headland in the 12 months before the claim.
13. Indemnity
You agree to defend and hold Headland Technologies Ltd. harmless from claims, damages, liabilities, costs, and expenses arising from your misuse of Headland, violation of these Terms, violation of law, or content and records you upload or enter.
14. Governing Law
These Terms are governed by the laws of Alberta and the applicable laws of Canada. Courts located in Alberta will have jurisdiction unless applicable law requires otherwise.
15. Changes to These Terms
We may update these Terms as Headland changes. Material updates will be posted with a new date, and where appropriate we may notify users through the app or by email. Continued use after changes means you accept the updated Terms.
